3. Seller Requirements
By selling Your Device to Swappie and agreeing to Swappie’s Terms and Conditions, You confirm that You are a private individual based in the European Union and legally capable of entering into a binding contract. You also confirm that you are of legal age to sell and profit from a Device. If you are under the required legal age, you must have the consent of a parent or legal guardian to sell Your Device to Swappie.
By selling Your Device to Swappie, You confirm that you are the lawful owner of the Device and have the full right to sell it and retain any payment resulting from the sale. The Device must have been previously used by You or be in your lawful possession. By submitting the Device to Swappie, You grant Swappie the right to inspect it, including the authority to physically open the Device in order to verify its condition, identify any missing parts or damage, and confirm authenticity.
You are required to give Your complete and accurate contact information, including Your name, billing and shipping address, an active telephone number and email address. In addition, Swappie reserves the right to request further information from You in connection with processing sales payments through our banking services. This information may include Your date of birth, place of birth and nationality/citizenship.
You are solely responsible for the accuracy of all the information You provide Swappie and are liable for any and all costs caused by giving incorrect contact information or banking information. If You do not provide the requested information within 14 days, Swappie may return the Device back to You. In such cases, You will be liable for all associated shipping costs.
Swappie maintains a customer register where Your personal data is stored for the purposes of managing and maintaining customer relationships, processing sales, and complying with legal obligations.
Please note that we may use automated tools, including artificial intelligence-based systems, to help us process customer communications (such as summarizing, categorizing, or authenticating Your requests). These tools are used only to support our services.
More information about the processing of personal data can be found in Swappie’s Privacy Policy.
4. Terms of Sale
Sales offers are valid for a maximum of 14 days from the date of submission. After that time, Swappie has the right to update the quoted price based at its sole discretion.
Once Swappie has received your Device and inspected it, Swappie may update the original price offer based on the actual condition and value of the Device at the time of inspection. Swappie will request Your acceptance to the final price offer by sending You a confirmation email. If You choose not to accept the revised price, your Device will be returned to You. If You do not answer this confirmation email within 14 days of receiving the email, Swappie will send a final email notification giving You 30 days to respond. If You do not respond within this 30-day period, ownership of the Device will automatically transfer to Swappie, the Device will not be returned to You and Swappie will automatically pay You the revised price according to the final price offer we have earlier sent You.
If the Device matches the condition declared in your sales form, the original estimated price will be confirmed and paid to You without the need for further acceptance by You, and ownership of the Device will transfer to Swappie at that point.
Swappie reserves the right to ask for further details regarding the ownership of the Devices, the original purchasing method and proof of Your identity to ensure You are authorized to sell the Device to Swappie. Swappie reserves the right to refuse the transaction at any stage, especially in cases where suspicious activity is detected, fraud is suspected, the payment process of the Device is unclear, or based on Your transaction history with Swappie, including exceeding any transaction limits set by Swappie.
The package sent to Swappie should contain only one (1) Device. If You are selling multiple Devices to Swappie, please pack them in separate Packages. Packages containing more than one (1) Device are considered dangerous goods, and You will bear all risk and responsibility if You incorrectly ship more than one Device to Swappie.
After Swappie has received Your Device and inspected it, ownership of the Device is immediately transferred to Swappie once the price is confirmed. If the Device matches the condition declared in your sales form, the estimated price will be confirmed and paid to you without the need for further acceptance. If the Device does not match the declared condition, ownership transfers when you accept the revised final price offer. You may cancel the sale at any time before shipping the Device to Swappie.
Any sale order and shipment made on Swappie’s Website using a shipping label provided by Swappie is under Your responsibility until the Device has been successfully delivered to Swappie’s Facility. You are free to choose any other shipping provider at Your own risk and expense. If using another shipping provider, You must still include the Swappie shipping label inside the Package as this is essential for identifying Your Device.
Please note that Swappie uses different shipping providers depending on the location. Each provider applies its own compensation terms for lost or damaged shipments. For details, please refer to the website of the relevant shipping provider.
You are responsible to take care of the content of the Package and its packing. Swappie does not take any responsibility if the Package gets lost or damaged during transit to Swappie’s Facility. Do not send us any additional items (eg. SIM cards, cables, cases, etc.) with the Device. Any additional items will be automatically discarded and not returned to You. The Device’s battery level must be at at least 30% when shipped.
In case there is any issue with the shipping or the delivery of the Device, Swappie may, at its own discretion, initiate an investigation on Your behalf directly with the respective shipping company and provide You with further information when available.
You are liable for the shipping costs for returning the Device in the following cases:
- The Device is a counterfeit or non-original Apple product.
- The Device has been previously disassembled or reassembled using non-original Apple parts.
- The contents of the Package do not contain a Device that matches the specifications of the submitted sales order.
- Any other reasons mentioned in these terms that prevent us from purchasing Your Device of which You should have been aware of.
Swappie may, at its sole discretion, accept intact unlisted models. If you wish to sell a model not currently listed on the Swappie Website, please contact us by filling in our contact form.
4.1. Condition of the Device
Before selling Your Device to Swappie, please erase the Device. To erase Your Device, go to Settings > General > Reset > Erase All Content and Settings. Note that this will erase all data from Your Device. While Swappie or its partners will erase any received Devices sold to Swappie, Swappie is not responsible for any data left on Device(s) that You have not erased in accordance with the above.
Swappie only purchases genuine Devices originally manufactured by the relevant Original Equipment Manufacturer (OEM). Devices must not be counterfeit, altered, or assembled with non-original Apple parts. Devices with the following conditions are not eligible for purchase:
- Water damage
- Bent housing
- Suspected motherboard issues
- Faulty biometric sensors (Touch ID or Face ID)
- Irreparable Home button cracks
- Active Find Devices (FMI) status
- Connectivity issues (Wi-Fi, GPS, SIM, Bluetooth)
- Evidence of non-original disassembly and reassembly
If your Device has Find Devices (FMI) turned on, You will have 14 days to turn off the FMI after we have contacted You. If we do not receive an answer from You within 14-days and the FMI is still on we will send you a final notification via email. If you do not turn off the FMI within 30 days after our second and final notification regarding this, we will consider the Device unpurchasable. In that case, Swappie will mark the order as paid at €0, and the Device will not be returned to You. Ownership of the Device will transfer to Swappie, and we will recycle the Device.
Swappie does not buy stolen Devices. Each Device’s legal status will be checked through the international CheckMEND database.

Swappie reserves the right to apply additional criteria, not explicitly listed here, when determining the condition category of a Device.
4.3. Devices not Eligible for Sale
For iPhone models 7 and below, Swappie does not offer any compensation, regardless of the state of the Device. Any iPhones below this model will be recycled and cannot be returned to You. Swappie also does not buy Blacklisted or MDM locked Devices. Due to shipping restrictions Swappie cannot purchase Devices with damaged batteries.
Blacklisted Devices
If the Device is found to have a record that indicates it has been lost or stolen, or Swappie becomes aware of any other issues related to its ownership (e.g. Blacklisted), Swappie will notify You by email and place the Device in quarantine for an initial period of 14 days (“the Quarantine Period”). Payment for the Device will be withheld by Swappie and the Device will not be processed for resale until the CheckMEND record does not show the Device as stolen or lost.
You are responsible for resolving the ownership issue during the Quarantine Period. This may include contacting the original seller, store, carrier provider or any third party that sold You the Device to prove that You are the rightful owner of the Device, have the lost or stolen records associated with it cleared within the Quarantine Period, and resolve any other issues relating to its ownership.
If the Device is cleared in the CheckMEND database during the Quarantine Period and no other ownership issues remain, Swappie will proceed with the sale and payment as normal.
However, if the Device is not cleared in the CheckMEND database within 30 days, the Device will be permanently recycled, and by entering into this contract, You expressly agree to this action. You will not receive any Payment if such steps are taken.
Swappie cannot, under any circumstances, pay for a Device which is lost, stolen or recorded as such, unless endorsed in writing by CheckMEND. If return shipping is required in such cases, You agree to pay any associated return costs.
If You have received Payment from Swappie for a Device and Swappie later becomes aware of an issue relating to ownership, You agree to immediately reimburse Swappie in full, within 3 business days following a written request by Swappie. This obligation applies regardless of whether the issue is under investigation by Swappie or any law enforcement body.
If the Device You sold to Swappie gets a Blacklist status after the Payment has been made, Swappie reserves the right to contact You and ask for Payment reimbursement. If the Blacklist status cannot be removed, You are responsible for returning the full payment received. Once Swappie has received the reimbursement in full, the Device will be returned to You, unless legal, regulatory, or law enforcement restrictions prohibit the return. In such cases, Swappie reserves the right to retain or dispose of the device in accordance with applicable laws or the instructions of law enforcement bodies.
If Swappie at any time becomes aware of any issues relating to the ownership of the Device, including after the transaction is complete, You agree to fully cooperate with Swappie and any relevant investigative bodies. This may include providing additional documentation, responding to inquiries, or engaging with law enforcement if required.
MDM (Mobile Device Management) locked Devices
MDM-locked Devices refer to the condition of a Device that is corporate-owned and is monitored and managed by corporate security software, normally a company or corporation. MDM-locked Devices cannot be purchased by Swappie under any circumstances, because You do not have the legal rights to sell or profit from the Device.
If Swappie receives an MDM-locked Device, it will be directly sent back to You at Swappie’s expense. However, if there is reasonable cause to believe that You were aware of the MDM status of the Device when submitting the order, Swappie reserves the right to charge You for the delivery costs.
5. Payment
The amount paid for Your Device is based on the Device’s model, memory and condition. Swappie tests all the Devices with industry-leading software.
If the Device matches the condition You declared, Swappie will pay the estimated price. However, the Payment may be smaller if the Device is in worse condition than You have stated. In the latter case, Swappie will send You a confirmation email that You need to approve in order to proceed with the updated Payment. If You choose not to accept the revised price, Your Device will be returned to You. If You do not answer this confirmation email within 14 days of receiving the email, Swappie will send a final email notification giving You 30 days to respond. If You do not respond within this 30-day period, ownership of the Device will automatically transfer to Swappie, the Device will not be returned to You and We will automatically pay You the revised price according to the final price offer.
If the returned Package is not picked up after it has been shipped back to You, and it is returned to Swappie’s Facility, You will be responsible for covering the shipping costs if You ask for the Package to be shipped back to You again.
If You believe that the Device returned to You is, for some reason, not in the same condition as it was when You originally sent it to Swappie, please contact Our Customer Service as soon as You notice the issue, preferably within 72 hours of receiving the Device.
Once the final price offer has been confirmed, the sale is considered final and You release Your rights to pursue any claims regarding the ownership of the Device. You will not be able to have Your Device returned and the price will be final.
You must bear in mind that You are solely responsible and liable for any mistakes regarding the Bank Information You have provided. By accepting the aforementioned clause, Swappie reserves the right to charge any bank investigation fees should You ask for further verification of transactions made to Your account. Fees must be transferred to Swappie’s bank account before Swappie proceeds with any investigation-related procedures.
You must fill in all the required details accurately in the online sales form for Swappie to make the Payment within the promised time frame. If the Device matches the condition as You have stated in the sales form, Swappie aims to process the Payment within the next business day after the Device has arrived at Swappie’s Facility. If the Device does not match the declared condition, Swappie will send you a revised price offer for confirmation. In such cases, the Payment will be processed within the next business day after you have accepted the revised offer. Swappie’s processing times may be affected by unexpected circumstances which may delay the process by a few days.
Any refunds or compensation requests need to be addressed by contacting Swappie’s Customer Service. Please note that Swappie reserves the right to decline refunds or compensation claims after a sale has been finalized.
You must promptly inform Swappie’s Customer Service of any irregularities regarding the Payment. If Swappie mistakenly overpays You, You must pay back the difference from the original amount within 7 days after the Payment was made. Swappie has the right to claim the overpaid funds and take further legal action if the situation so requires, should the amount not be transferred back to Swappie’s account in the agreed timeframe.
6. Limitation of Liability
Nothing in these Terms shall exclude or limit Swappie’s liability in any matter where it would be unlawful to do so.
Swappie is not liable for any indirect costs which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the products or to meet any of our other obligations under these Terms and Conditions where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident, terrorist activity, strikes, epidemics or quarantine. Swappie’s maximum liability to You for any loss or damage arising in connection with the Service shall be limited to the total price of the Device or Your order.
Liability for defects in the Device is strictly limited to the possible refund based on the assessed condition of the Device at the time it is received by Swappie.
7. Changes to the Terms & Conditions
We reserve the right to amend these Terms and Conditions from time to time without prior notice to You.
